- Knowingly or intentionally threatens another individual with bodily injury
- Knowingly or intentionally makes physical contact with another individual when they reasonably know that the individual would label the contact as offensive
Is Assault a Misdemeanor or Felony Charge?
Depending on the nature of the assault, the charge can be either labeled as a misdemeanor or a felony charge. Misdemeanors are split into three classes: Class A, Class B, and Class C, with Class A being the most serious misdemeanor charge. An assault charge can be classified as a felony if the circumstances of the assault were of a more serious nature, such as assaulting a public servant, member of the household, or a domestic partner.
Furthermore, the assault can be considered "aggravated assault" if the assault results in serious injury or if a deadly weapon was used. Aggravated assault can be charged as a first or second degree felony.
